Georgia Code provides a pathway for individuals to petition for release from the obligations of the Georgia Sex Offender Registry and associated restrictions on residency or employment. Under this provision, individuals who have fulfilled all prison, parole, supervised release, and probation terms for the offense necessitating registration can approach a superior court for relief.
The code also allows petitions from individuals convicted of crimes that were reclassified as misdemeanors after July 1, 2006, or from those required to register due to non-sexual offenses involving minors. Furthermore, those who have completed their sentence and meet the specific criteria in Code Section 17-10-6.2 are also eligible to file a petition.
Petitions should be filed in the superior court of the jurisdiction where the individual was convicted or, for those not convicted in Georgia, in the county of the petitioner's residence. After a petition is filed, it must be served to relevant district attorneys and sheriffs. If a petition is denied, a subsequent petition cannot be filed for two years.
Notably, release from registration requirements and restrictions does not automatically occur. The court will assess each case individually, considering evidence presented by both the petitioner and the district attorney or sheriff. A hearing will be held upon request by the petitioner, and a release order will only be issued if the court finds the individual does not pose a significant risk of committing future dangerous sexual offenses.
